Terms of Service

Welcome to Auto Swiper, a browser extension and Android application that automates profile swiping and — optionally — AI-assisted opening messages on supported dating platforms ("We", "Us", "Our"). By installing the extension, running the Android app, or signing in to your Auto Swiper account, you agree to these Terms of Service ("Terms"). Please read them carefully.

1. Introduction

Auto Swiper is offered as a browser extension (Chrome, Firefox, Edge, Vivaldi, Brave) and as a native Android application distributed via direct APK download from our website. Wherever these Terms refer to "the service" or "the extension", they cover both the browser extension and the Android app unless explicitly stated otherwise.

2. Eligibility

You must be at least 18 years old to use the service. By agreeing to these Terms, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement in your country of residence.

3. Acceptable Use

By using the service you agree that you will not:

1. Use the service in violation of the terms of service of any dating platform you visit through it. We provide the tool; you remain solely responsible for compliance with each platform's own rules and for any consequences (including account suspension) imposed by them.
2. Use the service to harass, stalk, defame, impersonate, threaten, deceive, or otherwise harm any individual.
3. Use the service in any way that violates applicable law, including but not limited to anti-spam, consumer-protection, and anti-discrimination laws.
4. Reverse-engineer, decompile, disassemble, or attempt to extract source code from the extension or Android app, except to the extent permitted by mandatory applicable law.
5. Resell, redistribute, share, sublicense, or transfer your account, login token, message credits, or subscription to any third party.
6. Circumvent or attempt to circumvent rate limits, usage quotas, subscription paywalls, or feature gating.
7. Use the service to operate a commercial "swiping-as-a-service" offering, agency, or paid match-making service for third parties.
8. Use automated scripts or bots to register fake Auto Swiper accounts, generate fraudulent referrals, or otherwise abuse our affiliate program.

Violations of this Section may result in immediate suspension or termination of your account under Section 11 (Termination).

4. Subscription

Auto Swiper offers four subscription tiers — Free, Basic, Pro, and Ultimate — each with its own set of included features, daily swipe quotas, and (where applicable) monthly AI-message allocations. The current feature list and pricing for each tier are published on our pricing page. By signing up for a paid subscription you agree to pay the applicable subscription fees as they become due plus any related taxes.

5. Payment & Refunds

Payment for subscriptions is processed by Stripe and will be billed on a recurring basis according to the plan you select at checkout. By subscribing, you authorize Stripe (on our behalf) to charge your provided payment method for these recurring fees.

Subscription billing options include:

1. 1-month plan: Billed every month on the same date as your initial purchase.
2. 3-month plan: Billed once every three months.
3. 12-month plan: Billed once every twelve months.

By subscribing, you agree to these recurring charges unless the subscription is canceled prior to the next billing cycle. For details, refer to Section 6 (Cancellation).

6. Cancellation

You may cancel your subscription at any time. Cancellations must be completed before the next billing cycle to avoid being charged for the upcoming period.

You have the following options to cancel your subscription:

1. Self-Service Cancellation: Log in to your account on our payment portal at https://app.auto-swiper.ch/ and cancel your subscription from the account management section.
2. Email Request: Send a cancellation request to our support team at support@auto-swiper.ch. Include your account details and submit your request before the next billing cycle to avoid being charged.

Once your cancellation request is processed you will retain access to the service until the end of your current billing period, after which your subscription will not renew.

7. AI Messaging

The Auto Swiper service includes an optional AI-powered messaging feature available to Pro and Ultimate subscribers (and, where applicable, on a beta basis to other tiers). By enabling AI messaging you acknowledge and agree to the following:

• Message credits. Each AI-generated message consumes one message credit. The number of credits included with your tier each billing period, and any available top-up purchases, are described on the pricing page. Credits do not roll over indefinitely, are non-transferable, and cannot be exchanged for cash.
• AI output is not guaranteed. AI-generated content is produced by a third-party large-language-model provider (currently OpenAI) based on the match's public profile information and recent conversation context. Output is not guaranteed to be accurate, appropriate, original, or aligned with your intent. You are solely responsible for reviewing each draft and for any message you choose to send.
• Acceptable use of AI messaging. You may not use AI messaging to send harassing, threatening, defamatory, sexually explicit (especially involving minors), discriminatory, or otherwise unlawful content; to impersonate any other real person; or to send spam, scams, phishing, or commercial solicitations. We may suspend AI-messaging access or terminate your account for violations.
• Beta features. Some AI-messaging features may be offered as beta. Beta features may change, be limited, or be removed without notice. We are not liable for incorrect, missing, or undelivered AI-generated messages, particularly while a feature is in beta.
• Data handling. Match profile data and recent conversation context are transmitted to our backend and downstream to OpenAI strictly to fulfil the generation request. See our Privacy Policy for details.

8. Intellectual Property

All content, features, source code, designs, trademarks, and functionality of the extension and Android app are and will remain the exclusive property of Auto Swiper and its licensors. Nothing in these Terms grants you any right, title, or interest in our intellectual property other than a limited, revocable, non-exclusive, non-transferable licence to use the service in accordance with these Terms while your subscription is active.

9. Warranty Disclaimer

The Auto Swiper extension and Android app are provided "AS IS" and "AS AVAILABLE" without warranty of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted/error-free operation. We do not guarantee that the service will result in specific matches, replies, dates, relationships, or any other personal outcome. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the above exclusions apply to the maximum extent permitted by law.

10. Limitation of Liability

In no event will Auto Swiper, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the service.

This includes, but is not limited to:

1. Account Bans or Restrictions: We are not responsible for any bans, suspensions, or restrictions imposed on your account by dating platforms as a result of using the service. You are advised to comply with the terms and conditions of each respective dating platform.
2. Loss of Data, Matches, or Conversations: Any loss of data, matches, conversations, or opportunities resulting from the use of the service.
3. Temporary Service Interruptions: Downtime or disruptions caused by updates or changes made by dating platforms, by our service providers (including Stripe and OpenAI), or by maintenance on our infrastructure.

By using the service you accept full responsibility for your actions and the potential risks associated with automated swiping and AI-assisted messaging on third-party platforms.

11. Termination

We may suspend or terminate your account, subscription, or access to the service at any time if:

1. You materially breach these Terms, including the Acceptable Use clause (Section 3) or the AI Messaging clause (Section 7);
2. Your payment method fails and remains unresolved after a reasonable grace period;
3. We receive credible reports that you are using the service to harm others or to violate third-party terms of service in a manner that exposes us to legal or reputational risk;
4. We are required to do so by applicable law, court order, or a competent regulator.

Where reasonably possible, we will notify you in advance and give you an opportunity to cure the breach. If we terminate your account for a material breach you forfeit any unused subscription period without refund. Sections 8 (Intellectual Property), 9 (Warranty Disclaimer), 10 (Limitation of Liability), 15 (Governing Law and Jurisdiction), and any obligation that by its nature should survive, will survive termination.

12. Site Updates and Service Interruptions

Dating platforms supported by the service may update their websites or mobile applications periodically. These updates can disrupt the functionality of the extension or Android app. While we strive to release fixes to restore compatibility as quickly as possible, there may be temporary interruptions in the service.

By using the service you acknowledge and agree that:

1. Service interruptions caused by external updates to dating platforms are beyond our control.
2. We are committed to addressing such interruptions promptly, but we cannot guarantee an immediate resolution.
3. Refunds or subscription adjustments will not be provided for short-term disruptions. If an issue persists for an extended period, we will assess reasonable compensation options on a case-by-case basis.

13. Affiliate Program

We offer an affiliate program where users can earn commissions ("Affiliate Commissions") for referring new paying users to Auto Swiper. By participating in the affiliate program you agree to abide by these Terms and the following additional terms:

• Eligibility: To be eligible for the affiliate program you must be a user in good standing with a valid, active account.
• Commissions: Affiliate Commissions are earned when a referred user completes a purchase of a subscription. The rate at which these commissions are earned will be communicated to you at the time of your enrolment in the affiliate program.
• Payment: Affiliate Commissions will be paid out on a schedule determined by us and communicated to you in advance. You are responsible for any taxes associated with commission fees.
• Termination: We reserve the right to terminate or suspend your participation in the affiliate program at any time, with or without cause. If we terminate or suspend your participation due to a violation of these Terms, you will not be eligible to receive any Affiliate Commissions that have accrued at the time of such termination or suspension.
• Prohibited Advertising: Affiliates are not permitted to use paid advertising, including pay-per-click (PPC) advertising, sponsored social media posts, or any other form of paid promotional activity, to promote their affiliate links. Any attempt to do so may result in immediate termination of the affiliate's participation in the program and forfeiture of any unpaid Affiliate Commissions.

14. Changes to the Terms

We reserve the right to modify these Terms at any time. We will always post the most current version on our website and update the "last updated" date below. For material changes we will additionally notify active subscribers by email or through the extension. By continuing to use the service after changes become effective, you agree to be bound by the revised Terms.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Switzerland, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Any dispute arising out of or in connection with these Terms or the use of the service shall be subject to the exclusive jurisdiction of the competent courts at the registered seat of Auto Swiper (see the Impressum), subject to any mandatory consumer-protection provisions of your country of residence that grant you the right to bring proceedings in your home courts.
